Tobacco company hit with over US$100k lawsuit by bike dealer

HARARE – A local tobacco company, Niche Tobacco has been dragged to court after allegedly failing to settle a US$108,000 debt owed to a motorcycle dealer, Speedbikes.

The money was for motorcycles and spare parts delivered to it over a year ago.

Niche Tobacco is jointly sued with its two directors Andrew Mupfawa and Richard Mhumhi.

In a civil suit filed through its lawyers Rubaya and Chatambudza Legal Practitioners, Speedbikes wants Niche Tobacco to pay the full amount plus interest.

“Sometime between January and February 2023, the 1st Defendant (Niche Tobacco) purchased 158 bikes and spare parts on credit from the Plaintiff for US$108,598.87.

“The Plaintiff delivered the bikes and spare parts worth US$108,598.87 to the Defendant.

“Notwithstanding delivery of the bikes and spare parts, the 1st Defendant failed to pay for the bikes and spare parts,” reads the declaration.

Speedbikes alleges that Mupfawa and Mhumhi have acknowledged the existence of the debt but they have not been forthcoming on settling what their company owes resulting in the suit.

“The 2nd and 3rd Defendants (Mupfawa and Mhumhi) acknowledged the debt on behalf of the 1st Defendant.

“Regardless of such acknowledgement and subsequent undertakings, the defendants have failed to make good of the debt, as they have become elusive and evasive.

“Despite demand, the defendants have refused/failed to pay the Plaintiff the purchase price of US$108,598.87 remains due and payable to Plaintiff,” the summons read.

The matter is yet to be heard.
